These Terms of Service ('Terms') govern your use of Valebyte services operated by Valebyte ('us', 'we', or 'our').
By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Definitions
- Service - refers to the hosting, server management, and related services provided by Valebyte

- Content - refers to all data, files, and materials stored on our servers
- Server - refers to dedicated servers, VPS, or other hosting infrastructure
2. Service Description
Valebyte provides:
- Dedicated server hosting services
- Virtual Private Server (VPS) hosting
- Server management and support
- Technical support services
- Network infrastructure and connectivity
We reserve the right to modify, suspend, or discontinue any service at any time with appropriate notice.
3. Account Registration and Security
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
- One person or legal entity may maintain only one account
4. Acceptable Use Policy
You agree not to use our services for:
- Illegal activities or content that violates applicable laws
- Spamming, phishing, or unsolicited communications
- Hosting malware, viruses, or malicious content
- Copyright infringement or intellectual property violations
- Activities that compromise network security or server stability
- Resource abuse or excessive consumption beyond allocated limits
- Adult content or services in jurisdictions where prohibited
- Cryptocurrency mining without explicit permission
5. Payment Terms and Billing
- Services are billed in advance on a monthly basis
- Payment is due within 7 days of invoice generation
- Late payments may result in service suspension after 15 days
- Setup fees, where applicable, are non-refundable
- Price changes will be communicated 30 days in advance
- Refunds are processed according to our refund policy
- Disputed charges must be reported within 30 days
6. Service Level Agreement (SLA)
- We guarantee 99.9% network uptime on a monthly basis
- Planned maintenance is excluded from uptime calculations
- Service credits are provided for verified downtime exceeding SLA
- Credits equal 5% of monthly service fee per hour of downtime
- Maximum monthly credit is 100% of service fees
- SLA claims must be submitted within 7 days of incident
7. Data and Backups
- You are solely responsible for backing up your data
- We are not liable for data loss under any circumstances
- Backup services, where provided, are supplementary only
- Data may be permanently deleted after account termination
- We reserve the right to remove illegal or infringing content
8. Service Suspension and Termination
We may suspend or terminate services for:
- Violation of these Terms of Service
- Non-payment of fees after grace period
- Illegal activities or abuse of service
- Violation of Acceptable Use Policy
Users may terminate services with 30 days written notice. Early termination fees may apply.
9. Intellectual Property
- You retain ownership of your content and data
- You grant us license to host and serve your content
- You warrant that your content does not infringe third-party rights
- Our service marks and trademarks remain our property
10. Limitation of Liability
- Our liability is limited to the amount paid for services in the preceding month
- We are not liable for indirect, consequential, or incidental damages
- Service interruptions due to force majeure are excluded
- Users should maintain appropriate insurance for business operations
11. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal data. By using our services, you consent to our data practices as described in our Privacy Policy.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or service notifications 30 days in advance. Continued use of services constitutes acceptance of updated Terms.
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the jurisdiction where Valebyte is incorporated
- Disputes should first be resolved through good faith negotiations
- Unresolved disputes may be subject to binding arbitration
- Each party bears its own legal costs unless otherwise awarded
